Padma Bhushan Harish Salve one of the best Indian lawyer, who represented Kulbhushan Jadhav at the ICJ, charged 1₹ as token fee. The verdict by International Court of Justice favored India, suspending the execution of Kulbhushan Jadhav and granting him consular access.
Kulbhushan Jadhav, a retired Indian Navy Officer was running a business in Iran. He was kidnapped from Iran by a Sunni group Jaish Ul Adil, and was handed over to the Pakistan Military. Pakistan officials arrested him on 3rd March 2016. Field General Court Martial (FGCM) in Pakistan sentenced his execution before the magistrate and court, on charges of ‘sabotage and espionage’ in April 2017, declaring him an Indian spy working for the RAW.
India took the case to the International Court of Justice. In May 2017, the ICJ stayed execution pending the final judgement on the case. 17th of July 2019, the ICJ gave its Verdict, suspending the execution of Kulbhushan Jadhav and granting him Consular access.
The verdict found Pakistan in violation of the Vienna Convention and asked the country to review Kulbhushan Jadhav’s conviction. Out of the 16 judges, 15 found Pakistan in violation of the Vienna Convention and the one who disagreed was a Pakistani Judge.
“The court has made it clear that Pakistan knew the nationality of Jadhav from the passport that they procured. Hence delaying a notification of his arrest to India was a violation of the Vienna Convention.” Says Harish Salve.
